The Honorable Phil Ting;
Last year I wrote praising you for the Audit of the Foreclosures in S.F.
County when you were Assessor.
You reminded me to contact you in the next early legislative session
regarding a proposal of a law requiring
Assessors to require foreclosing entities to be sent an Affidavit of
Authenticity to be signed under penalty of perjury
with wording from CA Pen Code 115.5, requiring a true signature to be
returned within a specified time and fees.
If the authenticated signature is not returned within said time period the
foreclosure would not be filed in the property records.
The state of Nevada stopped 75% of foreclosures in the first month of
enactment of such a law and CA should enact the same law.
I urge you to sponsor such a bill.
Sincerely,
