An interesting court case says that MERS cannot forclose on homeowners unles they can produce the original mortgage note signed by the homeowner. The banks had bundled securitized loans and sold them to investors multiple times losing the chain of title. So MERS has an impossible job. More reason to use eminent domain to transfer foreclosed properties  to counties and stop the avalanche of expected foreclosures-3,000 more in 2012.
