The Jan. 6 select committee probing Trump’s insurrection can release the maximum amount of investigative material before Republicans take over next month, making it harder for them to distort its findings. As Rep. Zoe Lofgren (D-Calif.), a committee member, told me: “Releasing all of it is important.”</p></div><div data-qa="article-body" style="max-width: 100%;" class=""><p data-qa="drop-cap-letter" data-el="text" style="max-width: 100%;" class="">Just how important was emphasized this<b style="max-width: 100%;" class=""> </b>week, when House Minority Leader Kevin McCarthy (R-Calif.) tipped his hand about GOP strategy in a way that passed largely unnoticed. In a <a href="https://republicanleader.house.gov/wp-content/uploads/2022/11/Rep-Lead-Sharp-MFP_20221130_124326.pdf" style="color: rgb(65, 110, 210); max-width: 100%;" class="">letter </a>dripping with a contrived, ominous tone, the man who hopes to be speaker instructed committee chair Bennie G. Thompson (D-Miss.) to “preserve all records collected and transcripts of testimony taken,” suggesting Republicans intend to scrutinize those findings in the majority.</p></div><div data-qa="article-body" style="max-width: 100%;" class=""><p data-qa="drop-cap-letter" data-el="text" style="max-width: 100%;" class="">The letter made news, even though the committee is already required by law to preserve all records and transcripts. The GOP majority will have access to all those records no matter what the committee publicly releases.</p></div><div data-qa="article-body" style="max-width: 100%;" class=""><p data-qa="drop-cap-letter" data-el="text" style="max-width: 100%;" class="">But buried in the letter is a cryptic reference with ugly implications for what’s to come. McCarthy <a href="https://republicanleader.house.gov/wp-content/uploads/2022/11/Rep-Lead-Sharp-MFP_20221130_124326.pdf" style="color: rgb(65, 110, 210); max-width: 100%;" class="">wrote</a> that Republicans want those materials preserved “with an eye toward encouraged enforcement of 18 USC 1001,” with no further comment.</p></div><div data-qa="article-body" style="max-width: 100%;" class=""><p data-qa="drop-cap-letter" data-el="text" style="max-width: 100%;" class="">What does that mean? Well, <a href="https://www.law.cornell.edu/uscode/text/18/1001" style="color: rgb(65, 110, 210); max-width: 100%;" class="">that statute</a> criminalizes lying to Congress. From that, I think, we can glean what might be<b style="max-width: 100%;" class=""> </b>one of the House GOP’s coming schemes: Dig through transcripts and other material to twist committee findings into “proof” that key elements of the anti-Trump testimony were deceptive, or even perjury.</p></div><div data-qa="article-body" style="max-width: 100%;" class=""><p data-qa="drop-cap-letter" data-el="text" style="max-width: 100%;" class="">That could function as a pretext to haul witnesses back for another grilling from Republicans. This would be deliberate spectacle: By publicly flogging witnesses who most damaged Trump, Republicans would provide grist for right-wing media to claim the most damning revelations had been decisively discredited, no matter what the facts show.</p></div><div data-qa="article-body" style="max-width: 100%;" class=""><p data-qa="drop-cap-letter" data-el="text" style="max-width: 100%;" class="">NYU law professor Ryan Goodman, who has <a href="https://www.justsecurity.org/82975/the-january-6th-hearings-a-comprehensive-guide-to-the-evidentiary-record/" style="color: rgb(65, 110, 210); max-width: 100%;" class="">closely tracked the Jan. 6 investigation</a>, agrees Republicans have tipped their hand. “They appear to be devising a tactic to try to undermine testimony, to the end of satisfying Trump and the far-right parts of the party,” Goodman told me.</p></div><div data-qa="article-body" style="max-width: 100%;" class=""><p data-qa="drop-cap-letter" data-el="text" style="max-width: 100%;" class="">As Goodman noted, Republicans don’t even have to grill witnesses again (which could backfire with sympathetic ones such as <a href="https://www.npr.org/2022/06/28/1108396692/jan-6-committee-hearing-transcript" target="_blank" style="color: rgb(65, 110, 210); max-width: 100%;" class="">former White House aide Cassidy Hutchinson</a>). With contractual deadlines looming, the idea of using an auto-pen was suggested to me, along with the assurance that this kind of thing is done ‘all the time’ in the art and literary worlds.”</span></p><p style="max-width: 100%;" class="">The ruse was uncovered by fans who shared pictures of the autographs of the limited-edition run of 900 “personally signed” copies of “The Philosophy of Modern Song” on social media and noted that they looked oddly similar. After some amateur sleuth work, they deduced that the autographs were created by an automated device.</p><p style="max-width: 100%;" class="">Each of the books had arrived with a letter from Simon & Schuster CEO Jonathan Karp vouching for the signature’s authenticity. The publisher later admitted to the deception in a <a href="https://www.instagram.com/p/ClMmYn9M2hu/" target="_blank" rel="noopener" style="color: rgb(65, 110, 210); max-width: 100%;" class="">statement posted on Instagram</a>. After initially refusing requests for refunds, it said it would offer them now.</p><p style="max-width: 100%;" class="">“To those who purchased ‘The Philosophy of Modern Song’ limited edition, we want to apologize,” Simon & Schuster wrote. “As it turns out, the limited edition books do contain Bob’s original signature, but in a penned replica form. We are addressing this immediately by providing each purchaser with an immediate refund.”</p><p style="max-width: 100%;" class=""><a href="https://datebook.sfchronicle.com/books/review-dylans-philosophy-of-modern-song-is-tangled-up-and-skewed" target="_blank" style="color: rgb(65, 110, 210); max-width: 100%;" class="">Review: Dylan’s ‘Philosophy of Modern Song’ is tangled up and skewed</a></p><figure class="clear" style="max-width: 100%; font-size: 0.75em; line-height: 1.5em; clear: both; color: rgba(0, 0, 0, 0.65); margin: 0px;"><img loading="lazy" src="https://s3.amazonaws.com/sfc-datebook-wordpress/wp-content/uploads/sites/2/2022/11/MER121721cc247f5a6c8ed46a3f98aa5_dylan1128-827x1024.jpg" alt="" width="827" height="1024" srcset="https://s3.amazonaws.com/sfc-datebook-wordpress/wp-content/uploads/sites/2/2022/11/MER121721cc247f5a6c8ed46a3f98aa5_dylan1128-827x1024.jpg 827w, https://s3.amazonaws.com/sfc-datebook-wordpress/wp-content/uploads/sites/2/2022/11/MER121721cc247f5a6c8ed46a3f98aa5_dylan1128-242x300.jpg 242w, https://s3.amazonaws.com/sfc-datebook-wordpress/wp-content/uploads/sites/2/2022/11/MER121721cc247f5a6c8ed46a3f98aa5_dylan1128-768x951.jpg 768w, https://s3.amazonaws.com/sfc-datebook-wordpress/wp-content/uploads/sites/2/2022/11/MER121721cc247f5a6c8ed46a3f98aa5_dylan1128-444x550.jpg 444w, https://s3.amazonaws.com/sfc-datebook-wordpress/wp-content/uploads/sites/2/2022/11/MER121721cc247f5a6c8ed46a3f98aa5_dylan1128.jpg 1105w" sizes="(max-width: 827px) 100vw, 827px" class="" style="max-width: 100%; margin: 0.5em auto; display: block; height: auto;"><figcaption style="max-width: 100%; margin-top: 0.8em; width: 1156px; font-size: 0.75rem; color: rgba(0, 0, 0, 0.8);" class="">“The Philosophy of Modern Song” by Bob Dylan.<span style="max-width: 100%; margin-top: 0.25em; margin-bottom: 0.25em;" class=""> Photo: Simon & Schuster</span></figcaption></figure><p style="max-width: 100%;" class="">“The Philosophy of Modern Song,” in which Dylan assesses compositions ranging from Hank Williams’s “Your Cheatin’ Heart” to Jackson Browne’s “The Pretender,” was published on Nov. 1.</p><p style="max-width: 100%;" class=""><span style="max-width: 100%;" class="">“Using a machine was an error in judgment and I want to rectify it immediately,” Dylan added in his statement. “I’m working with Simon & Schuster and my gallery partners to do just that.
