[Kzyxtalk] Safe Harbor - "a crucial element of public radio"

Dear Tim,

I just found this article online:

It includes a quote from you: "Late night programmer Tim Gregory stated that

it was a crucial element of public radio to have a time for freedom of expression.

Safe Harbor, formerly from 10pm to 6am, by legal precedent had been 

established to satisfy that intent and he was in favor of its quick return."

I'm a bit confused here. You can't get permission to use a certain word on your 

late night radio show. Yet it's a crucial element of public radio. So what does that

make your radio show? Non-crucial???

It's a relatively benign word, Tim. Not even listed among the seven dirty words:

If you can't get permission, then why not go ahead and use it? Please tell me

ahead of time so I can make a recording and send it to the FCC. You've got a

"legal precedent", right? What's stopping you?

Let's rewind with your original written comment to Norman: "you seem to have 

attracted a critical mass of assholes to yourself so far, and not much else..."

Then look at the timestamp: "23:07:03 PDT" -- cocktail hour. So what about 

bringing your favorite beverage/substance along? Something to loosen up the 

old tongue? Oh, I forgot. That's against Station Policy. Along with Safe Harbor.

On page 17: "As of this writing there is NO legal 'safe harbor' at any time of 

the day, however." Also, the word you're so ashamed of is expressly forbidden

by Federal law:

So what does that say about your so-called "legal precedent"? Since you're 

inclined toward dispensing advice, let me offer some. There's a reason that

certain conduct and language is prohibited on the public airwaves. It's beyond

what the law says. And what MCPB policy says. It's just plain common sense.

If you're ashamed of it anywhere, then don't do it. I've noticed that you've 

reigned in your language over the past few days. Good for you. Your conduct

could use a little work now. Like accusations of "cowardice" and the like. Which 

seem more like projections given your position. We can share the same ideas

without it.
