Meg Courtney, President
Mendocino County Public Broadcasting Board of Directors (MCPB)
Re: Ongoing Closed Board Meeting
Dear Ms. Courtney,
It has come to my attention that MCPB has been holding an ongoing closed board meeting.
According to former MCPB director King Collins (2003 - 2005), this has been going on since
2005:

As you and your fellow board members should know, closed board meetings are against
the Corporation for Public Broadcasting's terms and conditions. Violating them -- day in
and day out -- puts MCPB's grant funding at risk.
I realize that this meeting has been represented as an informal discussion, but the CPB
recognizes the following as a meeting:
"The term ‘meeting’ means the deliberations of at least the number of members of
a
governing or advisory body, or any committee thereof, required to take action on
behalf of
such body or committee where such deliberations determine or result in
the joint conduct
or disposition of the governing or advisory body’s business, or
the committee’s business,
as the case may be, but only to the extent that such
deliberations relate to public
broadcasting. §397(5)"

According to CPB's non-compliance policy, MCPB is required to document the reason for
closing any such meeting, and make that available to the public:
http://www.cpb.org/files/stations/non-compliance/CPB-CSG-Non-compliance-Policy-Effective-January-1-2016.pdf
So if you have any such reason, please do the following at your earliest possible convenience:
1. Respond by email what that reason is, and,
2. Post that reason on the KZYX website.
Furthermore, I demand for a hard copy of this communication to be generated and placed
in MCPB's public inspection file.
Sincerely,
Scott M. Peterson
