[CRNMC] County Supes meeting tuesday, 8/5, 9am to decide the fate of our Ordinance

County Supervisor's meeting, tuesday 8/5, will decide what course of action to take.  Here below is the agenda item and the code that refers to the County Counsel's recommendation. If they choose to do section C, then the ordinance will not be on the ballot till next year. The other option they have is to delete the sections they believe to be indefensible in court (which could eviscerate the community rights aspect) and submit the amended Ordinance to the voters instead of or in addition to our Ordinance (which would be very confusing to the voters - and I believe only the one which gets the most votes would become law). They could also choose to pass their own simple anti-fracking ban and put ours on the ballot. 

I have it from a good source that the Supes are tending to put it on the ballot as is and let the voters decide and take their chances on a lawsuit, which is probably unlikely because this is not a big money making place for the gas industry.

Recommended Action/Motion: Accept the certification of initiative signatures by the Mendocino County Registrar of Voters.

COUNTY COUNSEL

(b)        Decision Pursuant to Elections Code Section 9118 after Acceptance of Certification of Registrar of Voters of A petition titled "A Community Bill of Rights Ordinance Establishing A Community Bill of Rights For the People of Mendocino County Which Prohibits Fracking, and Which Provides for Enforcement of This Bill of Rights and Its Prohibitions"

Recommended Action/Motion: Choose one of the options available in Elections Code 9118.



California Elections Code Section 9118


9118.  If the initiative petition is signed by voters not less in
number than 10 percent of the entire vote cast in the county for all
candidates for Governor at the last gubernatorial election preceding
the publication of the notice of intention to circulate an initiative
petition, the board of supervisors shall do one of the following:
   (a) Adopt the ordinance without alteration at the regular meeting
at which the certification of the petition is presented, or within 10
days after it is presented.
   (b) Submit the ordinance, without alteration, to the voters
pursuant to subdivision (b) of Section 1405, unless the ordinance
petitioned for is required to be, or for some reason is, submitted to
the voters at a special election pursuant to subdivision (a) of
Section 1405.
   (c) Order a report pursuant to Section 9111 at the regular meeting
at which the certification of the petition is presented. When the
report is presented to the board of supervisors, it shall either
adopt the ordinance within 10 days or order an election pursuant to
subdivision (b).
