Here below is the agenda item and the code that refers to the County Counsel's recommendation. If they choose to do section C, then the ordinance will not be on the ballot till next year. The other option they have is to delete the sections they believe to be indefensible in court (which could eviscerate the community rights aspect) and submit the amended Ordinance to the voters instead of or in addition to our Ordinance (which would be very confusing to the voters - and I believe only the one which gets the most votes would become law). They could also choose to pass their own simple anti-fracking ban and put ours on the ballot. </span></p><p class="MsoNormal" style="margin-top: 12pt; margin-right: 0in; margin-left: 0.25in; margin-bottom: 6pt; text-align: justify; font-size: 20px; "><span style="font-variant: small-caps; font-size: 19px; ">I have it from a good source that the Supes are tending to put it on the ballot as is and let the voters decide and take their chances on a lawsuit, which is probably unlikely because this is not a big money making place for the gas industry.</span></p><div><br></div><div>Have a great weekend!</div><div>Karina</div><div><br></div><div><br></div><div><br></div><div><a href="http://www.co.mendocino.ca.us/bos/meetings/PublishedMeetings.htm">http://www.co.mendocino.ca.us/bos/meetings/PublishedMeetings.htm</a></div><p class="MsoNormal" style="margin-top: 12pt; margin-right: 0in; margin-left: 0.25in; margin-bottom: 6pt; font-size: 12pt; font-family: 'Book Antiqua', serif; text-align: justify; "><b><span style="font-size: 11pt; font-family: 'Californian FB', serif; font-variant: small-caps; ">ASSESSOR/CLERK-RECORDER<o:p></o:p></span></b></p><p class="MsoNormal" style="margin-top: 0in; margin-right: 0in; margin-left: 0.6in; margin-bottom: 6pt; font-size: 12pt; font-family: 'Book Antiqua', serif; text-align: justify; text-indent: -0.35in; "><b><span style="font-size: 11pt; font-family: 'Times New Roman', serif; font-variant: small-caps; "><span>(a)<span style="font: normal normal normal 7pt/normal 'Times New Roman'; "> </span></span></span></b><b><span style="font-size: 11pt; font-family: 'Times New Roman', serif; "><a target="fraDocuments" href="http://www.co.mendocino.ca.us/bos/meetings/MG37023/AS37031/AS37034/AI37103/Documents.htm" style="color: blue; text-decoration: underline; ">Acceptance of Certification of Initiative Signatures by the Mendocino County Registrar of Voters</a></span></b><b><span style="font-size: 11pt; font-family: 'Californian FB', serif; font-variant: small-caps; "><o:p></o:p></span></b></p><p class="MsoNormal" style="margin-top: 0in; margin-right: 0in; margin-left: 0.6in; margin-bottom: 6pt; font-size: 12pt; font-family: 'Book Antiqua', serif; text-align: justify; "><i><u><span style="font-size: 11pt; font-family: 'Times New Roman', serif; ">Recommended Action/Motion:</span></u></i><i><span style="font-size: 11pt; font-family: 'Times New Roman', serif; "> Accept the certification of initiative signatures by the Mendocino County Registrar of Voters.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-top: 12pt; margin-right: 0in; margin-left: 0.25in; margin-bottom: 6pt; font-size: 12pt; font-family: 'Book Antiqua', serif; text-align: justify; "><b><span style="font-size: 11pt; font-family: 'Californian FB', serif; font-variant: small-caps; ">COUNTY COUNSEL<o:p></o:p></span></b></p><p class="MsoNormal" style="margin-top: 0in; margin-right: 0in; margin-left: 0.6in; margin-bottom: 6pt; font-size: 12pt; font-family: 'Book Antiqua', serif; text-align: justify; text-indent: -0.35in; "><b><span style="font-size: 11pt; font-family: 'Times New Roman', serif; font-variant: small-caps; "><span>(b)<span style="font: normal normal normal 7pt/normal 'Times New Roman'; "> </span></span></span></b><b><span style="font-size: 11pt; font-family: 'Times New Roman', serif; "><a target="fraDocuments" href="http://www.co.mendocino.ca.us/bos/meetings/MG37023/AS37031/AS37038/AI37105/Documents.htm" style="color: blue; text-decoration: underline; ">Decision Pursuant to Elections Code Section 9118 after Acceptance of Certification of Registrar of Voters of A petition titled "A Community Bill of Rights Ordinance Establishing A Community Bill of Rights For the People of</a><u><span style="color: blue; "> Mendocino County Which Prohibits Fracking, and Which Provides for Enforcement of This Bill of Rights and Its Prohibitions"</span></u></span></b><b><span style="font-size: 11pt; font-family: 'Californian FB', serif; font-variant: small-caps; "><o:p></o:p></span></b></p><p class="MsoNormal" style="margin-top: 0in; margin-right: 0in; margin-left: 0.6in; margin-bottom: 6pt; font-size: 12pt; font-family: 'Book Antiqua', serif; text-align: justify; "><i><u><span style="font-size: 11pt; font-family: 'Times New Roman', serif; ">Recommended Action/Motion:</span></u></i><i><span style="font-size: 11pt; font-family: 'Times New Roman', serif; "> Choose one of the options available in Elections Code 9118.</span></i></p><h1 style="font-weight: bold; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 1.5em; color: rgb(0, 0, 0); "><br></h1><h1 style="font-weight: bold; font-family: Georgia, 'Times New Roman', Times, serif; font-size: 1.5em; color: rgb(0, 0, 0); ">California Elections Code Section 9118</h1><div><br></div><span class="Apple-style-span" style="font-family: Georgia, 'Times New Roman', Times, serif; "><pre style="font-size: 1.1em; ">9118.
